These Terms of Service (“Terms”) govern your use of the kmtraders.in website and mobile application operated by KM Traders, located at Main Road, Madikeri, Coorg, Karnataka 571201. By accessing or placing an order through our platform, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our platform.

1. Eligibility

You must be at least 18 years old to create an account and place orders. By using our platform, you represent that you meet this age requirement and that all information you provide is accurate and complete.

2. Orders & Product Availability

• Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order at our discretion.
• Product availability and pricing are subject to change without notice. In the event of a pricing error, we will inform you and give you the option to confirm or cancel the order.
• Images and descriptions of products are for illustrative purposes only. Actual products may vary slightly due to packaging changes or seasonal variations.

3. Delivery

• We currently deliver within the Madikeri area. Delivery zones and minimum order amounts are displayed during checkout.
• Estimated delivery times are provided in good faith but are not guaranteed. Factors such as weather, traffic, and high demand may affect delivery schedules.
• You are responsible for providing an accurate and accessible delivery address. Failed deliveries due to an incorrect address may be charged an additional fee.
• Please ensure someone is available to receive the order at the provided address.

4. Payment

All orders are currently fulfilled on a Cash on Delivery (COD) basis. Please have the exact amount ready at the time of delivery. We reserve the right to introduce additional payment methods in the future.

5. Cancellations & Refunds

• You may cancel an order before it has been dispatched for delivery. Once dispatched, cancellation is not guaranteed.
• If you receive a damaged, incorrect, or missing item, please contact us within 24 hours of delivery with photographic evidence. We will arrange a replacement or credit at our discretion.
• Fresh perishable items (fruits, vegetables, dairy) are generally non-refundable unless they are delivered in a spoiled or clearly unacceptable condition.

6. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately at support@kmtraders.in if you suspect any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

7. Prohibited Uses

You agree not to:

• Use our platform for any unlawful purpose or in violation of any applicable law.
• Place fraudulent, duplicate, or test orders with no intention of payment.
• Attempt to gain unauthorised access to any portion of our platform, servers, or databases.
• Scrape, crawl, or systematically copy our product listings or pricing without prior written consent.

8. Intellectual Property

All content on this platform — including the KM Traders name, logo, product images, and website design — is the property of KM Traders and is protected by applicable intellectual property laws. You may not reproduce or use any of this content without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, KM Traders shall not be liable for any indirect, incidental, or consequential damages arising from your use of our platform or the products purchased through it. Our total liability in any matter shall not exceed the value of the order in question.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kodagu (Coorg) district, Karnataka.

11. Changes to These Terms

We may revise these Terms at any time by updating this page. The “Last updated” date at the top of this page will reflect when changes were made. Your continued use of the platform after any changes constitutes your acceptance of the new Terms.
